Digital Millennium Copyright Act (DMCA) Policy

CS2Energy respects intellectual-property rights and expects visitors and users of this website to do the same. This policy describes how copyright owners may report material on CS2Energy.com that they believe infringes their rights and how affected parties may respond.

1. Copyright Infringement Notices

In accordance with the Digital Millennium Copyright Act, including 17 U.S.C. § 512, CS2Energy will review properly submitted notifications of claimed copyright infringement and may remove or disable access to material when appropriate.

• Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by one notice, a representative list of those works.
• Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to permit CS2Energy to locate the material.
• Your name, mailing address, telephone number, and email address or other information reasonably sufficient to permit CS2Energy to contact you.
• A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the owner’s agent, or the law.
• A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

2. Where to Send a DMCA Notice

3. Response to a Valid Notice

Upon receipt of a notice that substantially complies with applicable law, CS2Energy may investigate the claim and remove or disable access to the material where appropriate. When material was supplied by another party and applicable procedures require notice to that party, CS2Energy may provide notice of the removal or restriction.

4. Counter-Notification

If material that you provided was removed or disabled as a result of a copyright notice and you believe the removal resulted from mistake or misidentification, you may submit a written counter-notification pursuant to 17 U.S.C. § 512(g).

A counter-notification should include substantially the following:

• Your physical or electronic signature.
• Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, and telephone number.
• A statement consenting to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g)(3), and a statement that you will accept service of process from the person who submitted the original infringement notification or that person’s agent.

5. Restoration of Material

When applicable, CS2Energy may forward a valid counter-notification to the party who submitted the original notice. Material may be restored in accordance with the timing and procedures established by 17 U.S.C. § 512 unless the complaining party provides notice that it has filed an action seeking a court order concerning the disputed material.

6. Repeat Infringement

When applicable to website accounts or user-submitted content, CS2Energy reserves the right to restrict or terminate access by users who repeatedly infringe copyrights or other intellectual-property rights, and to remove content that violates these Terms, this policy, or applicable law.

7. Misrepresentations

Copyright notices and counter-notifications are legal communications. A person who knowingly makes a material misrepresentation that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability under 17 U.S.C. § 512(f).

8. CS2Energy Copyrights and Intellectual Property

Unless otherwise identified, original written content, graphics, photographs, illustrations, videos, page layouts, branding, logos, diagrams, and other original materials appearing on CS2Energy.com are owned by CS2Energy or used with permission. Manufacturer names, trademarks, product information, certification marks, photographs, technical materials, and other third-party content remain the property of their respective owners.

Nothing on this website grants a license to reproduce, republish, distribute, sell, modify, or commercially exploit protected material except as expressly permitted by the applicable rights holder or by law.

9. Designated-Agent Registration

Section 512(c)(2) and applicable Copyright Office regulations establish separate requirements for an online service provider seeking the statutory safe harbor for material stored at the direction of users. Those requirements include making designated-agent information publicly available and registering that agent electronically with the U.S. Copyright Office.

Publication of this webpage by itself does not constitute or represent completion of a U.S. Copyright Office designated-agent registration. If CS2Energy registers or updates a designated agent for purposes of Section 512, the applicable public agent information should be maintained both on this website and in the Copyright Office’s designated-agent system.

10. Important Clarification

The DMCA notice-and-takedown framework is principally relevant when a service provider hosts or transmits material supplied by third parties. It does not automatically shield a person or business from direct copyright-infringement claims concerning material that the person or business itself creates, selects, or publishes.

11. Changes to This Policy

CS2Energy may revise this policy when website features, applicable law, Copyright Office requirements, or business practices change. The current version will be posted on this page with a revised effective date.
